Through the Platform, Hermeneus World offers any person (hereinafter, the "Buyer") the possibility of purchasing online various products that are marketed by independent stores, businesses and merchants belonging to certain municipal markets of Valladolid or located in the city of Valladolid (hereinafter, the “Businesses”). The Platform is a marketplace whose essential purpose is to facilitate a direct relationship between Buyers and Businesses, allowing Buyers to have at their disposal a wide showcase of products that they can purchase online and directly from the Businesses that put them on sale.

The products available for purchase on the Platform are in all cases marketed directly by the Merchants themselves. Hermeneus World in no case manufactures, produces, markets or sells the products available on the Platform. Therefore, Buyers understand that, when a purchase is made through the Platform that is accepted by the respective Merchant, it is the selling Merchant (and not Hermeneus World) who sells the product to them and that, therefore, a direct relationship with the Merchant whose product they have purchased, without in any case Hermeneus World being part of the contractual relationship that is created directly between the Buyer and the Merchant when concluding a purchase through the Platform.

Hermeneus World is an information society service provider that operates the Platform and whose function is solely to provide access to a Platform through which Merchants can market their products and Buyers can purchase products directly from the businesses that sell them. In this sense, Hermeneus World is limited to (i) making available to Buyers and Merchants a set of functionalities that allows them to conclude the purchase and sale of products directly between them; (ii) act as authorized collection agent of the Merchants to accept, on their behalf, the payments made by the Buyer through the Platform, Hermeneus World concluding the sale of the products exclusively in the name and as authorized commercial agent of the Merchants. Shops; and (iii) in some cases, coordinate and manage the transportation of the products in cases where the Buyer selects the delivery of the order to his or her address, through external logistics companies .

3. Scope of application and acceptance.

These general terms and conditions of use (hereinafter, the “Conditions of Use”) regulate the use of the functionalities and services available on the Platform, as well as the conditions applicable to the purchase of products from the Merchants that They are available on the Platform at all times. The use of the services available on the Platform entails the full and unreserved acceptance of these Conditions of Use by the Buyers and the Merchants (hereinafter, both jointly, the “Users”).

Sometimes, the acquisition of certain products may be subject to particular conditions that may be established by the Merchants that sell them, which, depending on the case, replace, complete and/or partially modify these Conditions of Use. Therefore Therefore, Buyers must take into account that the corresponding particular conditions of the Merchants that are shown in the descriptive sheets of the products and/or during the purchase process may also be applicable.

4. Conditions of access and use of the Platform.

The Platform is reserved for Users over 18 years of age. By accepting these Conditions of Use, the User expressly confirms that he or she is of legal age. Without prejudice to the foregoing, Hermeneus World reserves the right to request accreditation of this requirement and to prevent the registration or cancel the account of any User who does not sufficiently prove his or her legal age after having been required to do so.

Access and navigation through the Platform does not require prior registration for Buyers. Buyers will be able to view and consultall the information about the Businesses and their products without the need to register. However, to purchase the products available on the Platform, you must complete a registration process based on a standardized form in which you must complete certain information that is mandatory. During the purchase process, the Buyer must create a password that will allow them to create and have a user account through which they can make future purchases on the Platform without having to complete all the data for each purchase, as well as consult their Purchase history and details of all your orders. Likewise, in this way the Buyer will be able to have a single user account for other platforms that are owned by Hermeneus World at any given time.

Likewise, to register as a Merchant, you must complete a registration process and provide Hermeneus World with certain mandatory information. The use of the Platform by the Merchants is subject to certain additional contractual conditions that the Merchants must accept to register on the Platform, which complement what is established in these Conditions of Use and specifically regulate the conditions applicable to Businesses for the marketing of their products through the Platform. The person who completes the Merchant's registration process on the Platform and who accepts these Conditions of Use on its behalf expressly declares and guarantees that it has sufficient authorizations or powers to accept the terms provided for in these Conditions of Use on behalf of the Merchant, whether legal or natural person, and to bind the Merchant to the terms provided in these Conditions of Use. Hermeneus World is not responsible for the lack of veracity in the data provided or statements made by the person who completes the registration process in name of a Business.

Users guarantee the accuracy, legality, veracity and updating of all the information they provide through the forms enabled on the Platform or in any other way, whether during their registration or at any other time. Hermeneus World declines any responsibility for any inconveniences, damages or incidents arising from errors, omissions or lack of accuracy, updating or veracity of the information provided by the User at the time of registration or when making any purchase or reservation. Users are responsible for preserving the security of their account at all times and understand that they will be fully responsible for any action or performance carried out under their user account by any person to whom they facilitate or allow access to their account.

Section II. General purchasing conditions.

5. Introduction.

This section sets out the general conditions that apply to all purchases made through the Platform and that constitute the conditions that the Merchants that sell their products on the Platform undertake to comply with under their sole responsibility.

Since Hermeneus World does not manufacture, produce, market or sell the products available on the Platform, Buyers understand that, when they make a purchase through the Platform, a direct relationship is created with the Merchant whose product they have purchased, of which Hermeneus World is in no way a part. For this reason, the Merchants themselves, and not Hermeneus World, are solely responsible to Buyers for the products sold, for the information provided about them, for their condition and packaging, for any legal guarantee associated with the respective product and, in general, of any liability derived from the marketing and sale of its products.

Hermeneus World does not offer any guarantee about the quality or condition of the products sold by the Merchants and declines all responsibility regarding any incident or liability arising from the sale concluded directly between the Buyers and the Merchants. Buyers understand and accept that Hermeneus World cannot take responsibility for any responsibility that corresponds to the Merchants, since they are the ones who market and sell their products directly to the Buyer.

6. Description and price of the products.

When they publish their product catalog on the Platform, Merchants are responsible for including a description of the products they sell, so that Buyers can make the purchase in an informed manner. The description, prices, weights and other characteristics of the products, as well as the information about the Merchant itself, are based exclusively on the information and photographs that are included on the Platform directly by the Merchants themselves or at their indication under their sole responsibility. Buyers will always have the possibility of requesting additional information from Merchants before making the purchase, through the Merchant's own contact channels that appear on the Platform.

Although Hermeneus World does its best to ensure that the information available on the Platform is complete, up-to-date and error-free, given that the information and content about the products and the Merchants themselves are incorporated directly by the Merchants or at their request under its responsibility, Hermeneus World declines any kind of responsibility for any omission, error or lack of veracity, precision, updating and correctness of said information.

The photographs of the products are only intended to illustrate, as an example, the appearance of the products and provide visual information that complements their written description, but said photographs do not necessarily reflect the real or exact appearance of the product. Furthermore, due to technical limitations or the characteristics of the devices or monitors used by Users to view the photographs, sometimes the tones, colors, finishes or dimensions of the products may not correspond exactly to the actual appearance of the products. The Buyers recognize, therefore, that these photographs have merely indicative and illustrative value.

The prices of the products shown on the Platform include VAT. and other taxes that may be applicable. However, product prices do not include transportation costs that, where applicable, may be applicable. Transportation costs, when applicable, will be shown during the purchase process for the Buyer's knowledge and acceptance before making payment for the order.

7. Purchase and payment process.

The purchasing process is very simple and intuitive. The Buyer simply has to select the products they are interested in purchasing and the selected products will be added to the “Basket” or “Shopping Cart”. Each time a product is selected, the Buyer will have the option to continue purchasing or complete the purchase, in which case the order processing and payment process will begin. Orders may be made up of products from a single Merchant or, sometimes, products from different Merchants may be grouped in the same order when they are Merchants that are part of the same market.

Payment for all orders must be made by credit card through the payment gateway enabled on the Platform to facilitate payment between Buyers and Merchants. In processing payments, Hermeneus World acts as a mere intermediary between the Buyer and the Merchant(s) whose products the Buyer has purchased and is limited to concluding the sale of the products exclusively on behalf of and as commercial agent of the Merchant(s) the markets. Therefore, once payment has been made, the Buyer will be released from his payment obligation to the Merchant(s) whose products he has purchased, Hermeneus World being responsible for settling in favor of each Merchant the amounts corresponding to them. the purchase made and without prejudice to the Buyer's right to request a refund directly from Hermeneus World in the cases established in these Conditions of Use and in the applicable legislation.

To make the payment, the Buyer must use a credit or debit card Visa, Mastercard, American Express, Visa Electron and/or other similar cards that are compatible with the payment gateway enabled on the Platform. The card with which the payment is made must have as the issuing financial entity a Spanish bank or savings bank or a branch or subsidiary financial entity of a foreign financial entity with an establishment in Spain. All transactions that take place through the Platform's POS will be carried out through the payment gateway enabled by a financial institution that applies due security measures in payment processing according to the applicable legal requirements. Due to the security measures applied by the financial entities issuing the cards, the Buyer may need to verify the payment through the authentication measures indicated by their respective banking entity (through their online banking, SMS, etc. .). Furthermore, at Hermeneus World we ensure the security of Buyers' information: that is why the Platform works and has SSL certificates (https) to guarantee safe navigation through the Platform. SSL certificates guarantee secure transmission of information over the Internet, since the transmission of information The data between the server and user is produced in an encrypted manner without putting your information at risk.

In order to prevent fraudulent operations, Hermeneus World reserves the right to request information and confirmations from Buyers, even after having made one or more purchases through the Platform, in order to confirm that the Buyer had actually authorized the payment, as well as to carry out checks on the transactions carried out. If any improper charge is made to your credit card, the Buyer must immediately notify Hermeneus World, through the “Contact” section, so that Hermeneus World can carry out the pertinent investigation and adopt the appropriate measures. depending on each case.

Once the purchase process is completed and payment has been made, the Buyer will receive a first provisional confirmation of the order. This first confirmation only means that the order has been placed correctly and that the request for the products has been sent to the respective Merchant(s) so that they can proceed with its confirmation and preparation. Once the first confirmation is received, changes to the order will only be allowed as long as the Merchant has not started preparing it and accepts it depending on the availability of products and other factors, so Hermeneus World cannot guarantee that such changes will be possible. be realized. In any case, the final purchase is subject to prior acceptance and validation of the order by the corresponding Merchant, which may reject it totally or partially depending on the availability of the requested products.

When the order includes food products subject to weight (meat, fish, fruits, etc.), the final quantity of the product and, therefore, the final purchase price may vary upwards or downwards depending on the exact weight of the corresponding product requested. In any case, the final weight and price will in no case exceed more than 10% of the requested weight, so the Buyer will never be charged an amount greater than that excess. The Buyer authorizes any variations that may occur (up or down) in the final price of the order as a result of weighing, with the maximum excess indicated above.

Once the order has been confirmed and validated by the corresponding Merchant in view of the availability of the requested products and, where applicable, the weight of the products, the Buyer will receive a final purchase confirmation indicating the products that , depending on their availability and weight, make up the final order, which will include the final purchase price that will be charged to the payment card used when making the purchase. Upon receipt of the final confirmation of the purchase, the purchase will be deemed concluded and no changes or cancellations will be accepted.

The supporting documents for each purchase will be available for consultation in the Buyer's user account. If the Buyer wishes to receive an invoice for the purchase, they must contact directly the Merchant from whom they made the purchase to request it.

8. Delivery and shipping of the order.

During the purchase process, the different delivery or shipping options available will be displayed. In general, the Buyer may select between picking up the order at the Merchant's own establishment (or, when this system is available, in lockers enabled in the market where the Merchant is located) or requesting home delivery. In any case, please note that it is the Merchants themselves who establish their own delivery and shipping options, so some of these options may only be available in some Merchants or markets and may, therefore, not be available at all times. or in all cases. In any case, the Buyer will be able to know this information while placing the order.

Likewise, please note that the home delivery option may be restricted to certain locations or geographical areas and that there may be a minimum purchase amount. In these cases, if the delivery address indicated during the order processing process is not within the enabled delivery areas or the home delivery service requires a minimum purchase amount, this circumstance will be reported during the ordering process. order processing.

During the purchase process, the Buyer may choose to request the delivery of the order to the address used to create their user account or another address they specify for the delivery of that specific order. The delivery address indicated by the Buyer must in all cases be included within the delivery areas enabled by the respective Merchant and must be an address where delivery can be made on the selected date and time slot. Neither Hermeneus World nor the Merchant will be responsible for any expenses, incidents or delays arising from any error or omission by the Buyer when specifying the delivery address or the impossibility of making delivery due to causes attributable to the Buyer on the date or time. selected time (e.g. recipient absent at the address indicated on the expected delivery date or time); The Buyer must be responsible for any additional costs that, if applicable, may be generated as a result of these assumptions.

At the time of delivery of the order, if requested, the Buyer must indicate/show their identification document to the carrier and sign the delivery note or delivery confirmation. The estimated delivery time will be displayed during the order processing process. The indicated deadlines are estimates, as they are subject to circumstances beyond the control of the Commerce and Hermeneus World or to circumstances of force majeure (strikes, riots, etc.) that may occasionally prevent delivery in the selected time slot or day. Hermeneus World declines any responsibility for delays arising from these types of circumstances. In any case, the delivery period will never exceed thirty (30) calendar days from the day following the day on which the Buyer made the purchase.

The delivery is considered to have been made from the moment in which the order is made available to the Buyer at the delivery location indicated by the latter during the processing of the order or, in the event that the Buyer has opted for collection at the Merchant itself or in lockers enabled in the market, at the time the order is collected.

9. Returns.

Right of withdrawal.

In accordance with applicable legislation, the Buyer will have a maximum period of fourteen (14) calendar days from receipt of the order to withdraw from the purchase, without the need for any justification and without penalty of any kind. In any case, it is expressly noted that the right of withdrawal will not be applicable in the cases established in the applicable regulations, especially, by way of example and not limitation, in the following cases: (i) when it refers to goods that may deteriorate or expire quickly (for example, fresh or short-expired food products); (ii) in the case of packaged or sealed food products that have been unsealed after delivery, because they are not suitable to be returned for reasons of health protection or hygiene; or (iii) when it concerns goods made in accordance with the consumer's specifications or clearly personalized.

In any case, the Buyer must return at his sole expense to the respective Merchant the product(s) on which he exercises the withdrawal, with the original packaging, seals and labeling. Merchants will not accept returns when there are clear signs of use by the Buyer beyond those necessary to verify the characteristics of the product or when they are returned with open seals or with clear signs of opening or use. No refund will be made so if the returned products do not meet the above conditions.

Once the Merchant has received the returned product(s) and verified that they are in the same condition in which they were delivered and without signs of opening or use, Hermeneus World will refund the Buyer the price of the order and the initial shipping costs paid by the Buyer when purchasing the product(s) on which the withdrawal has been exercised. The refund will be made using the same payment method used by the Buyer for the initial transaction, unless the Buyer has expressly requested otherwise. In any case, the Buyer will not incur any expenses as a result of the refund. Hermeneus World may withhold the refund until the Merchant confirms that it has received the goods subject to withdrawal or until the Buyer has presented proof of their return, depending on which condition is met first.

Incidents and errors in orders.

In the event that the Buyer receives an erroneous or incomplete order or any incident occurs in the delivery of an order, the Buyer must contact the selling Merchant directly or the customer service available on the Platform. , which will be responsible for communicating the incident to the corresponding Merchant in order to resolve the incident and find a solution. In the event that the order is erroneous, the Buyer will have the right to request a refund of the purchase price, shipping costs and, where applicable, the costs of returning the order, without prejudice to any other solution that may be found. depending on each case.

10. Legal guarantee and after-sales service.

Durable products purchased through the Platform, in accordance with the provisions of the applicable regulations, are covered by a legal guarantee for lack of conformity for a period of three years from the date of delivery of the product. Given that the products are sold directly by the Merchants, they will be the ones who must directly address any claim from the Buyers as a result of the lack of conformity or defects of the product and who must, where appropriate, proceed with the repair or replacement of the defective product. in the terms established in consumer regulations. Section III. Intellectual property and conditions of use of the Website.

11. Intellectual property.

Hermeneus World is the owner of the intellectual property rights relating to or inherent to the Platform, including its design, format, structure and the software, databases and codes necessary for its operation and, as the case may be, is the owner or licensee of the intellectual or industrial property rights related to photographs, images, texts, logos, brands, trade names and other content that is hosted and/or available through the Platform. The brands, trade names, logos and/or any other distinctive signs of third parties other than Hermeneus World that may eventually be displayed on the Platform are the property of their legitimate owners and are protected by Law, and their use is strictly prohibited without the express consent of their owners. corresponding holders.

The publication by Users of any material, text, photography and/or content (“User Content”) through the Platform or its sending to Hermeneus s World, through the contact channels and/or functionalities enabled on the Platform, automatically attributes to Hermeneus World a non-exclusive, free, non-revocable, worldwide and sub-licensable license to use, display, adapt, distribute, communicate publicly and exploit the User Content for any purpose related to the services and functionalities of the Platform, as well as to carry out promotional actions for Hermeneus World and/or the Platform through any channel.

Given that Merchants must provide their online store with information, images, texts and content within the Platform in accordance with the functionalities enabled by Hermeneus World for this purpose, each Merchant is fully responsible for the contents, texts, images, logos and information that you publish or share through the Platform or that you send or provide to Hermeneus World for this purpose. By publishing or sending it, the Merchant automatically grants Hermeneus World a non-exclusive, free, temporary license (as long as your user account as a Merchant is active) and without territorial limitation, to host, reproduce and publish the Merchant's contents through the Platform with the necessary scope to adequately provide the Platform's own services, as well as to carry out promotional actions for the Platform and the Commerce through any channel, making them available to Buyers and the general public. Although Hermeneus World is not obliged to control or review the content that the Merchant publishes and without prejudice to the Merchant's full responsibility for the content that it stores or publishes through the Platform, Hermeneus World will be entitled to remove any content published by the Merchant. 12. Obligations and prohibitions.

Users undertake to make diligent use of the Platform and the functionalities available therein in full compliance with the Law and these Conditions of Use. With a particular and non-limiting nature, it is strictly prohibited: (i) access, interfere with, manipulate or use any area or functionality of the Platform that is not public in nature or vocation or to which access has not been given, as well as any act that aims to violate, evade or manipulate the security of the Platform. Without prejudice to any other legal actions that may apply in each case, Hermeneus World may permanently suspend or cancel, at its sole discretion, the account of any User who performs any action that constitutes a breach of these Conditions of Use. Users must hold harmless and, where appropriate, compensate and indemnify Hermeneus World, its directors, employees, agents or any other related persons, with respect to any claims, liabilities, damages, losses, expenses or any other concepts that have been caused directly or indirectly as a consequence of any violation of the provisions of these Conditions of Use by the User.

Section IV. Limitation of liability and other general issues.

13. Exclusion of guarantees and liability.

However, given the characteristics of the Internet, Hermeneus World cannot guarantee: that the Platform will be error-free and work uninterrupted; the complete invulnerability of the Platform and the absence of harmful components in the Platform or in the server that provides it; nor the full reliability, usefulness, availability and continuity of the Platform's functionalities.

In particular and to the maximum extent permitted by Law, Hermeneus World declines any type of responsibility for any damages, incidents or inconveniences of any nature that the User or third parties may suffer as a consequence of: (i) the use of the Platform or its contents and functionalities in any way that may imply a violation of any national or international regulation, intellectual or industrial property rights or any other right of third parties, or of these Conditions of Use; (ii) possible security or operating errors that may occur due to the fact that the User uses non-updated versions of software or the consequences that may arise from the malfunction of their computer, terminals, equipment and/or devices. , whether due to improper configuration, presence of computer viruses or any other cause beyond the control of Hermeneus World; (iii) interruptions, delays, errors, unavailability or malfunctioning of the Platform or its functionalities that have their origin in causes beyond the control of Hermeneus World, derived from services or actions of third parties outside Hermeneus World or that have their origin in causes of force majeure, such as Internet network or server outages, computer attacks, etc.; (iv) errors produced by incidents attributable to internet access providers or as a consequence of the impossibility or difficulty of integration with the Merchant's systems or due to the lack of capacity, compatibility or sufficiency of the Merchant's equipment or means to operate. the same; (v) errors or lack of diligence by the Merchant or its staff in the use of the functionalities of the Platform or actions that are exclusively attributable to the people who access and/or manage/use the Merchant's user account in their name or with your authorization; (vi) the information or content that Users host, publish, transmit or disseminate through the Platform, as well as errors, omissions or lack of accuracy, updating or veracity of the information provided by the User at the time of registration or when making any purchase or reservation.
